User Agreement

1. Acceptance of the Agreement

This User Agreement is a legally binding agreement between you and NDK DIGITAL LLP regarding your use of NDK VPN.

By downloading, installing, accessing, registering for, purchasing, or otherwise using NDK VPN, you agree to this User Agreement. If you do not agree, you must not use the service.

2. Eligibility

You may use NDK VPN only if you are legally able to enter into a binding agreement under the laws that apply to you. If you use the service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to this User Agreement.

If the service is not legally available in your country, region, or for your age group, you must not use it.

3. License Grant

Subject to your compliance with this User Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use NDK VPN on devices that you own or control for lawful personal or internal business purposes.

You may not:

• sell, rent, sublicense, assign, or redistribute the app or service;
• reverse engineer, decompile, disassemble, modify, adapt, or attempt to derive the source code except where expressly permitted by law;
• remove, alter, or obscure proprietary notices, branding, or legal notices;
• use the service in a manner that bypasses our technical, contractual, or security restrictions.

4. App Store and Platform Terms

If you obtain NDK VPN through Apple App Store, Google Play, or another distribution platform, your use of the app may also be subject to that platform's terms, policies, billing rules, and consumer protections.

You acknowledge that the relevant platform provider is not responsible for providing support, maintenance, or warranty service for the app except to the extent required by applicable law or the platform's own terms.

5. Accounts and Credentials

Certain features may require or allow you to create, recover, or link an account, including by using an anonymous account session or linking an email address for account recovery.

• You agree to provide accurate, current, and complete information where requested.
• You are responsible for keeping your credentials, devices, and recovery methods secure.
• You are responsible for activity under your account unless otherwise required by law.
• You must promptly notify us if you suspect unauthorized access to your account.
• We may require identity or account verification before processing certain account, support, billing, or deletion requests.

6. Subscriptions and Billing

Some features of NDK VPN require a paid subscription. Subscription options, trial periods, prices, billing intervals, renewal terms, and available payment methods are shown at the point of purchase.

Auto-Renewal

Unless otherwise stated, subscriptions renew automatically at the end of each billing period until cancelled.

Cancellation

You may cancel renewal through the store account or payment method used for the purchase. Cancellation generally takes effect at the end of the current paid period unless otherwise required by law or the billing provider's rules.

Payments and Refunds

Payments, renewals, restores, and refunds may be processed by Apple, Google, or another third-party billing provider. For website purchases, available methods may include bank card and other options displayed at checkout. Refund availability depends on applicable law and the policy of the provider that processed the payment.

7. VPN Service Limitations

NDK VPN is designed to help create an encrypted connection and route supported traffic through available VPN servers. The service is provided on an as available basis.

We do not guarantee:

• continuous availability of all servers, countries, or endpoints;
• uninterrupted service, specific speeds, or latency levels;
• compatibility with all networks, carriers, devices, apps, or websites;
• access to any specific website, streaming service, or online platform;
• absolute anonymity, absolute security, or protection from every threat model.

8. Acceptable Use

You may use NDK VPN only for lawful purposes and in compliance with this User Agreement.

You must not use NDK VPN to:

• violate any law, regulation, court order, or third-party right;
• distribute malware, spyware, spam, phishing content, or other harmful material;
• perform unauthorized access, intrusion, denial-of-service, credential abuse, or network abuse;
• interfere with the operation, integrity, or security of our infrastructure or other users;
• resell or commercially exploit the service without our prior written consent;
• use the service in countries or situations where such use is prohibited by law.

9. Updates and Service Changes

We may modify, update, suspend, or discontinue any part of NDK VPN at any time, including server locations, features, pricing, compatibility, and technical limits.

We may also release patches, maintenance updates, bug fixes, or security updates. In some cases, continued use of the service may require that you install the latest version of the app.

10. Third-Party Services

NDK VPN may rely on or integrate with third-party providers, including app stores, payment processors, hosting services, analytics services, crash-reporting services, support tools, infrastructure vendors, security providers, and VPN node providers.

We are not responsible for third-party services, websites, or terms that are outside our control. Your use of those services may be governed by separate agreements between you and the third party.

11. Privacy and Data Processing

Our collection, use, disclosure, retention, and protection of personal data are described in the NDK VPN Privacy Policy, which is incorporated into this User Agreement by reference.

By using NDK VPN, you acknowledge that your information may be processed as described in the Privacy Policy, including for account administration, subscriptions, support, security, fraud prevention, diagnostics, and service operation.

12. Suspension and Termination

We may suspend or terminate your access to all or part of NDK VPN if:

• you violate this User Agreement;
• we suspect fraud, abuse, unauthorized access, or security risks;
• we are required to do so by law, court order, regulator, or law enforcement;
• continued operation of your account or usage would create technical or legal risk for us, our vendors, or other users.

You may stop using the service at any time. Termination does not automatically entitle you to a refund except as required by law or by the policy of the payment provider that processed your transaction.

13. Disclaimer of Warranties

To the maximum extent permitted by law, NDK VPN is provided on an as is and as available basis, without warranties of any kind, whether express, implied, statutory, or otherwise.

We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability, security, accuracy, and reliability, except where such disclaimers are prohibited by law.

14. Limitation of Liability

To the maximum extent permitted by law, NDK DIGITAL LLP and its affiliates, officers, employees, contractors, licensors, and service providers shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages.

This includes loss of profits, business interruption, data loss, device failure, loss of goodwill, loss of opportunity, or security incidents arising out of or related to your use of or inability to use NDK VPN.

Where liability cannot be fully excluded, our aggregate liability will be limited to the amount you actually paid for NDK VPN during the 12 months preceding the event giving rise to the claim, or the minimum amount required by applicable law, whichever is greater.

15. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless NDK DIGITAL LLP and its affiliates, officers, employees, contractors, and licensors from and against any claims, liabilities, damages, losses, and expenses arising out of or related to:

• your use or misuse of NDK VPN;
• your violation of this User Agreement;
• your violation of any law or third-party rights.

16. Governing Law

This User Agreement is governed by the laws of England and Wales, without regard to conflict-of-law rules, except where mandatory consumer protection laws provide otherwise.

Any dispute arising from or relating to this User Agreement or NDK VPN shall be subject to the courts of England and Wales, unless applicable law requires a different venue, forum, or dispute process.

17. Changes to This Agreement

We may update this User Agreement from time to time. The most current version will be posted at https://ndkvpn.com/user-agreement/.

Your continued use of NDK VPN after the updated version becomes effective means that you accept the revised User Agreement, unless applicable law requires a different form of notice or consent.
